Each end-user visitor to the Site agrees to comply with and be bound by the following Terms and Conditions ("Terms and Conditions"), as well as the Agreement (as defined below) in its entirety, when she/he: (a) accesses or uses the Site; (b) accesses and/or views any of the Site's viewable blog posts, text, graphics and/or other material (collectively, "Content"); (c) utilizes any of the interactive areas of the Site, such as blog and comment sections, that enable end-users to interact with third parties, as well as BrightTrials.com personnel ("Interactive Services"); (d) utilizes the searchable database ("Database") in order to view clinical trial listings ("Listings") as made available by BrightTrials.com's third party research partners ("Research Partners") (collectively, the "Listing Services"); and/or (e) signs up to receive e-mail alerts about Listings that meet the end-user's preselected criteria (the "E-mail Alert Services," and together with the Site, Content, Interactive Services, Database, Listings and Listing Services, the "Site Offerings").
The BrightTrials.com Privacy Policy ("Privacy Policy") and any and all other applicable BrightTrials.com operating rules, policies, price schedules and other supplemental terms and conditions or documents that may be published from time to time, are expressly incorporated herein by reference (collectively, the "Agreement"). Please review the complete terms of the Agreement carefully. If you do not agree to the terms and conditions of the Agreement in their entirety, you are not authorized to use the Site Offerings in any manner or form.
The Site Offerings are available only to individuals who can enter into legally binding contracts under applicable law. The Site is not intended for use by individuals under eighteen (18) years of age (or the applicable age of majority, if greater than eighteen (18) years of age). If you are under eighteen (18) years of age (or the applicable age of majority in your jurisdiction, if greater than eighteen (18) years of age) and/or if you are unable to enter into legally binding contracts under applicable law, you do not have permission to use and/or access the Site Offerings.
The Agreement constitutes the entire and only agreement between you and BrightTrials.com with respect to your use of the Site Offerings, and supersedes all prior or contemporaneous agreements, representations, warranties and/or understandings with respect to the Site Offerings. We may amend the Agreement from time to time in our sole discretion, without specific notice to you.
The Listing Services provide end-users with the opportunity to: (i) conduct searches for various Research Partners (including Clinical Research Organizations, Sponsors, and Research Sites) by location and medical condition; (ii) view the Listings that match the Research Partner search results; and (iii) obtain contact information for such Research Partners in order to contact them regarding their Listings. Please be advised that: (A) BrightTrials.com does not itself conduct the clinical trials or provide the medical services provided by any of the Research Partners; and (B) the Listings and the associated terms and conditions of any clinical trial offering featured in the Listings ("Clinical Trial Offering") will be determined by the subject Research Partners.
Upon entering your Registration Data (including e-mail address and medical conditions of interest) and clicking on the "Find Trials" or "Sign Up" button, your Registration Data may be used by BrightTrials.com to send you e-mail alerts of Listings that match your criteria and/or provided to Research Partner(s) in order to facilitate contact between you and such Research Partner(s).
BrightTrials.com does not sponsor, recommend or endorse any Research Partners, Listings and/or Clinical Trial Offerings. BrightTrials.com has no control over the quality, safety, or legality of the Research Partners or Listings. The determination of the need for medical treatment and the choice of participation in a study are extremely important decisions and should not be based solely on advertisements or compensation rates offered by any Research Partner.
BrightTrials.com does not involve itself in the informed consent process or agreements arrived at by and between end-users and Research Partners. End-users are solely responsible for assessing the competency and trustworthiness of all Research Partners.
The Site contains Content including information pertaining to medical conditions and clinical research. Please use caution and common sense when using the Content. Do not rely on the Content when making any medical decisions. BrightTrials.com does not monitor Feedback submitted by end-users and operates comment sections as a neutral host.
Use of the Site Offerings is subject to the Privacy Policy. We reserve the right to use all information regarding your use of the Site Offerings in accordance with the terms of the Privacy Policy.
As a user of the Site Offerings, you are granted a non-exclusive, non-transferable, revocable and limited license to access and use the Site Offerings and associated Content in accordance with the Agreement for your own personal, non-commercial use.
The content, organization, graphics, design, compilation, magnetic translation, digital conversion, software, services and other matters related to the Site Offerings are protected under applicable copyright, trademark and other proprietary rights. Systematic retrieval of material from the Site by automated means or any other form of scraping or data extraction is strictly prohibited.

BrightTrials.com strictly prohibits any advertising, marketing or other type of promotion of its Site through any form of network abuse, spyware, denial of service or other illegal activity. Violations should be reported to: privacy@brighttrials.com.
You agree to indemnify and hold BrightTrials.com harmless from and against any and all claims, expenses (including reasonable attorneys' fees), damages, suits, costs, demands and/or judgments whatsoever, made by any third party related to or arising out of: (a) your use of the Site Offering(s) and/or any Clinical Trial Offering(s); (b) your breach of the Agreement; (c) any dispute between you and a Research Partner; and/or (d) your violation of any rights of another individual and/or entity.
THE SITE OFFERINGS AND ANY CLINICAL TRIAL OFFERINGS ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS AND ALL WARRANTIES, EXPRESS AND IMPLIED, ARE DISCLAIMED TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW. BRIGHTTRIALS.COM MAKES NO WARRANTY THAT: (A) THE SITE OFFERINGS OR CLINICAL TRIAL OFFERINGS WILL MEET YOUR REQUIREMENTS; (B) THE SITE OFFERINGS WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (C) YOU WILL QUALIFY FOR ANY CLINICAL TRIAL; (D) THAT YOU WILL REALIZE ANY HEALTH BENEFIT, CURE, OR FINANCIAL COMPENSATION; OR (E) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE OFFERINGS WILL BE ACCURATE OR RELIABLE.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT BRIGHTTRIALS.COM SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL AND/OR EXEMPLARY DAMAGES INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES. THIS INCLUDES DAMAGES ARISING FROM YOUR FAILURE TO REALIZE ANY HEALTH BENEFIT, CURE, OR FINANCIAL COMPENSATION. IF APPLICABLE LAW DOES NOT PERMIT SUCH LIMITATION, THE MAXIMUM LIABILITY OF BRIGHTTRIALS.COM TO YOU UNDER ANY AND ALL CIRCUMSTANCES WILL BE FIVE HUNDRED DOLLARS ($500.00).
The Site may provide links to other Internet websites including government registries (e.g., ClinicalTrials.gov). BrightTrials.com is not responsible for the availability, content, or privacy policies of such third-party websites.
The Agreement shall be governed by the laws of the State of New York. Disputes shall be resolved by arbitration before a reputable arbitration organization as mutually agreed upon by the parties, in accordance with the American Arbitration Association rules. To the extent permitted by law, you agree that you will not bring, join or participate in any class action lawsuit against BrightTrials.com.
The Agreement is personal between you and BrightTrials.com and governs your use of the Site Offerings. BrightTrials.com may assign its rights and obligations under the Agreement, in whole or in part, to any party at any time without any notice to you.
By utilizing the compensation or stipend estimate features on BrightTrials.com, you explicitly acknowledge that the provided estimates are approximations derived from available data and are not intended to serve as definitive representations of actual stipends or compensation. We encourage users to seek additional verification of all compensation details directly with the research site or sponsor.
